Rhonda McKeever and Howard Richman both reported the sand has been graded by the Town around our access walkways. I bugged the Town about this, and they finally got to it.

As you probably know, our beach will be re-nourished this summer. The work is tentatively scheduled to be performed in the August-September timeframe, and it will have some impact on anyone visiting our beach.
Some of you, especially new owners, may have questions. The Town and its beach nourishment dredging contractor, Weeks Marine, will be holding a public meeting on Wednesday, April 6 at 3:00 p.m. in the Paul F. Keller Meeting Hall. You are invited to attend in person or online. After a brief presentation from Weeks Marine, you will be able to ask questions. This meeting will be live-streamed and recorded for later viewing on the Town YouTube page. Links will be provided by the Town closer to the meeting date. All of us turned our clocks ahead today. Spring activities on the Outer Banks have started, and summer is just around the corner.

As you may recall, several years ago Duck DVO business owner Robert Hovey used the private Sand Dollars Shores (SDS) subdivision ocean access walkway for his surfboard customers so they could get to the ocean beach for surfing and for lessons that he conducted. The SDS HOA complained about Hovey doing this as they own and maintain the walkway, and they never intended it to be used by the general public. Hovey sued SDS over the issue. The initial judge found in favor of Hovey. SDS appealed that judgement to the NC Appeals Court, and that court unanimously reversed the initial judgement. Hovey then appealed that judgement to the NC Supreme Court. Last week, the NC Supreme Court dismissed the Hovey appeal, so this issue is now finally settled in favor of SDS maintaining their walkway as a private walkway.
This is an important case and conclusion. There are around 50 subdivisions in Duck, which includes Carolina Dunes of course, and most of them have ocean access walkways. Our 3 walkways were constructed and are maintained by CDA for private use. There are no Duck, Dare County or NC taxes used to maintain our walkways. CDA dues cover 100% of the expenses. Had the Hovey case been settled in favor of Hovey, our walkways might have been forced, in time, to be open and to be available to the general public. Additional car traffic and parking issues would likely have ensued. The NC Supreme Court ruling is significant and important to us. In a recent email to you, I asked owners who have time and energy to shovel some sand at the 3 ocean access walkways to make them more usable until the Town picks up on doing this around Easter. Tim Wier on Duck Road took this to heart, responded and shoveled sand at the Sprigtail walkway. He did a great job, and that walkway is now more usable again. Thank you Tim!! I noticed other owner(s) have also shoveled sand at the Canvasback and Widgeon walkways, making them more usable as well. I don't know who these owners are, but I want to thank them as well! All owners are still encouraged to continue to shovel sand when you can. Thank you in advance for helping make the beach more accessible! Here's a picture of the work Tim did. Here's an update on the Little Libraries. If you recall Dale Desnoyers on Old Squaw offered to build 2 Little Libraries. Thank you Dale! He has completed these, and they will be installed at the Sprigtail and Widgeon walkways when he is back in Duck later this month. Also, if you recall Noel Woodruff on Wood Duck offered to build a 3rd Little Library. Thank you Noel! She also completed her LL, and Jamie Bartlett on Pintail helped me mount it yesterday at the Canvasback walkway. See picture below. Jamie also helped me construct all of the mounting posts and brackets at all 3 walkways. Thank you Jamie! I now have one more request for owners. A 'Call for Books' for the Little Libraries, starting with the one at the Canvasback walkway. Just put them inside of Noel's LL. When Dale's LLs are mounted, we will also need books for them as well.
